Tonight for public administration, I have a debate. I’m excited. See, this is where I excel. I just hope that the girl I’m up against is well prepared…

The topic is the USA PATRIOT Act, and the question is “does the government have a right to spy on its own citizens?” I am against the government spying on its own citizens.

I will probably start with the history of how our civil liberties have been infringed upon during various times in this country (Alien and Sedition Acts of 1798, the Civil War, World War II, McCarthyism, the Vietnam War, etc.), and how few of those attempts was particularly successful, and in the view of history were incorrect.

Then of course I will talk about the specific Amendments that are violated by spying on American citizens.

Here’s my favorite quote that I will be using:

“From time immemorial, despots have used real or imagined threats to the public welfare as an excuse for needlessly abrogating human rights… The…constitutional rights of an accused individual are too fundamental to be sacrificed merely through a reasonable fear of military assault. There must be some overpowering factor that makes a recognition of those rights incompatible with the public safety before we should consent to their temporary suspension.”  –Justice Frank Murphy, Duncan v. Kahanamoku (1946)

Then of course, I will show that these overpowering factors do not exist because the methods used by the FBI and the Department of Justice haven’t been overly successful nor have they used proper procedure (even the less strict proper procedure!) to use those methods.

    As a general rule, I’m against the government spying on people. ME spying on people is a whole other matter. I have a thing for night vision goggles. I blame that.

    Wow! I am so impressed that I “know” a smart girl. wheeee!! That makes me smart by default, yah know. Even though I have no idea what I just read. 😉 Kidding. I know about spying. Same reason as green canary!

    I want to say like Valley or something like that. He was on the news for his school a few months ago….I believe he might have been staring at the reporters boobs… I’m going to have to do a name search. Do you remember his first name?
