a blessing in disguise

Trial practicum is over for this year, which was certainly unexpected. Yesterday the jury came back with a guilty verdict on two different counts of theft for the first defendant. Then, we watched voir dire for the next case which involved assault on a peace officer. After breaking for lunch, the judge sat us down and explained that the State was dismissing the case.

Which, to be sure, was a total and complete surprise to all of us.

They dismissed the case because none of the three officers they had set to testify could make it to court. It seemed a little odd to me, but whatever… Anyway, the State had no evidence to present and the jurors had already been sworn in. So the case was dismissed, which means that the defendant is off the hook no matter what because after the jury was sworn in the notion of double jeopardy comes into play. Even though there was no evidence presented in the case, it counts as a trial and the defendant cannot be tried for the same crime twice. So we got to watch our Constitution at work, so to speak.

So…I’m back in class today. The good news? I only have one class this morning and then I’m volunteering for a mock trial tournament this afternoon. And then I get to go home! I definitely need this three-day weekend. *yawn*

    Yay for the three day! That is odd though, all three of the cops couldn’t make it to court?!

    Colsy: I thought so. My guess is that there may have been something fishy about their story, but that’s pure speculation.

    Jansen: That’s part of what made me choose Drake. 🙂
